Full Ts&Cs (“Terms”):
READ THESE TERMS CAREFULLY BEFORE PARTICIPATING. YOU WILL BE DEEMED TO HAVE ACCEPTED THESE TERMS AND AGREED TO BE BOUND BY THEM WHEN PARTICIPATING IN THIS COMPETITION. AMONG OTHER THINGS, THESE TERMS INCLUDE LIMITATIONS OF YOUR RIGHTS AND REMEDIES.
1. The “Uber Eats Football Competition” (the “Competition”) is open to all individual Uber Eats account holders, who are compliant with the Uber Eats User Terms, aged 18 years or over, and resident in the UK (the “Territory”). Employees of the Promoter, their families, agents or any third party directly associated with the administration of the Competition are not permitted to enter the Competition. Proof of age and/or identity and/or residency may be required.
2. The promoter of this Competition is: Uber Portier B.V., a company registered under the laws of the Netherlands (registration number: 65851307) whose registered address is Meester Treublaan 7, 1097 DP, Amsterdam, the Netherlands (“Promoter”).
3. The Competition will be open for entries from 09.00 on 22 June 2021 to 23.55 on 4 July 2021 (the “Competition Period”). Entries received after the Competition Period will not be included in the Competition.
4. To enter the Competition you must:
- Have an active Uber Eats account; and
- Post your video content entry of you at home scoring a goal or showcasing your football skills (“Content”) on Twitter, Instagram or Facebook with the hashtag “#BringItHome”; and
- Post your Content during the Competition Period.
You will automatically be entered into the Competition if you have complied with the above.
5. In order for your entry to be considered eligible for the Prize, it must comply with the following requirements:
- The Content must last a maximum of 30 seconds.
- The Content must contain no verbal or visible reference to the Euros (to be decided at the Promoter’s discretion), including but not limited to references to teams competing in the Euros and players playing for those teams.
- The Content must not contain any expletives, profanities or other potentially offensive material (to be decided at the Promoter’s discretion).
- The Content must reflect the following traits (to be decided at the Promoter’s discretion): (i) skillfulness; (ii) originality; (ii) playfulness; and (iv) cultural relevance.
6. The Promoter accepts no responsibility for entries to the Competition not being successfully completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure.
7. One (1) prize is available to win in the Competition. The winner of the Competition will, subject to their continued compliance with the Uber Eats User Terms and these Terms, receive one (1) year of free food, drink, and/or other items (up to a maximum aggregate redemption value of £2400) ordered through the Uber Eats app in the Territory (the “Prize”).
8. The Prize excludes delivery fee, service fee, and other fees (such as small order fee) where applicable. Delivery fees and service fees will apply. Other fees (such as small order fee) may apply. The Prize is non-exchangeable, non-transferable and no cash alternative is offered. The Prize is not redeemable on alcohol or tobacco products (or certain other products that Promoter may in its discretion make unavailable for redemption with promotional offers from time to time). The Prize is redeemable by applying the voucher code (provided to you by Promoter) at the checkout of the Uber Eats app (using the Prize winner’s Uber Eats account). The Prize will be available for redemption between 09.00 on 11 July 2021 and 11.55 on 10 July 2022 or when the Prize winner has redeemed items via the Uber Eats app equalling a total aggregate value of £2400 or more, whichever is sooner. The Prize does not include any food and drink, spending money, travel expenses, tax or personal expenses. Any other costs in addition to those set out in clause 7 are the responsibility of the Prize winner.
9. In addition to the Prize, additional promotional offers of £15 off your next order through Uber Eats will be available on a weekly basis during the Competition Period for the first 100 Prize-eligible entries successfully submitted (each an “Additional Promotional Offer”). The Additional Promotional Offer will be subject to separate terms and conditions that will be notified to you prior to your redemption of such an Additional Promotional Offer.
10. The winner of the Prize will be chosen by a judging panel consisting of Chris Kamara and an independent adjudicator on 6 July 2021 (“Decision Date”).
11. The winner will be notified by email or telephone (using details linked to their Uber Eats account) on 6 July 2021 and must respond to the notification to claim their Prize within 48 hours. Failure to do this will result in the Prize being forfeited and the Promoter may in its absolute discretion award the Prize to a reserve selected at the same time as the original winner or dispose of the Prize in its discretion without liability to the winner.
12. The Prize may take up to 24 hours to be available to redeem on the Uber Eats app from the date the winner claims the Prize under clause 11.
13. The Promoter assumes no responsibility for any typographical or other error in the administration of the Competition, errors in processing entries, identifying the winner, announcing the winner or the delivery of the Competition.
14. The Promoter reserves the right to replace the Prize with an alternative Prize of equal or higher value if circumstances beyond the Promoter’s control make it necessary to do so.
15. The decision of the Promoter regarding any aspect of the Competition is final and binding and no correspondence will be entered into about it.
16. The name of the winner and county can be obtained by sending an email to UKIrestaurantinfo@uber.com within 30 days of the date of the Decision Date.
17. Participants are deemed to have accepted and agreed to be bound by these Terms upon entry to the Competition. The Promoter reserves the right to refuse entry or refuse to award the Prize to anyone in breach of these Terms. The Promoter reserves the right to hold void, cancel, suspend, or amend the promotion where it becomes necessary to do so (in the Promoter’s sole discretion).
18. Insofar as is permitted by law, the Promoter, their agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize except where it is caused by the negligence of the Promoter, their agents or distributors or that of their employees. Your statutory rights are not affected. Any liability of the Promoter arising in connection with the Competition shall be several and the Promoter accepts no joint and several liability in connection with the Competition.
19. The winner of the Prize may be asked to participate in publicity related to the Competition which may include the publication of their name and photograph in any media.
20. By entering this Competition you agree to the following:
- The broadcasting and live or as-live broadcast of your Content by the Promoter (or by its affiliates, partners or subcontractors) and you hereby assign to us absolutely with full title guarantee all existing and future rights (including without limitation copyright and performers’ property rights) in such Content and all consents necessary to enable us to make full use of the Content worldwide in perpetuity in any and all media, whether now known or hereafter developed or discovered, and whether as part of the Competition or as part of other content owned, controlled or represented by the Promoter, without payment, liability (save as specifically set out in this agreement) or acknowledgement to you.
- Promoter (and its affiliates, partners or subcontractors) shall be entitled to edit, copy, add to, adapt or translate the Content, and dub it into foreign languages, at our discretion and, in respect of the Content, you hereby irrevocably waive in favour of us, our assignees and licensees the benefit of all moral rights and performers’ rights arising under the Copyright, Designs and Patents Act 1988 or similar rights arising under the laws of any jurisdiction.
- You grant the Promoter (and its affiliates, partners and subcontractors) the right to issue publicity relating to the Content, the Competition and any other programme in which it may be included and to use and publish for such purposes the Content, your name, photograph or likeness, details about you, recordings of you and interviews with you for such purposes.
21. You acknowledge that you understand and agree that we do not undertake to broadcast, exhibit or otherwise exploit the Content.
22. You warrant and undertake that:
- You are aged 18 years or over.
- You are fully entitled to enter into this agreement and to grant all rights in the Content to us and have the legal capacity to enter freely into this agreement with us.
- The Content will be genuine and truthful and will not infringe the copyright or any other right of any third party or breach any contract or duty of confidence, data protection law or the Official Secrets Act or other legislation relating to national security, constitute a contempt of court or be obscene, defamatory or blasphemous.
- You acknowledge that we shall not be liable for any loss, damage or injury suffered by you in connection with your participation in the Competition other than death or personal injury caused by our negligence.
23. The Promoter reserves the right to modify and amend these Terms in exceptional circumstances (as assessed by Promoter, acting reasonably) during the Competition Period, subject always to such changes not unfairly prejudicing the Prize winner or any entrants to the Competition.
24. The invalidity or unenforceability of any provision, or part thereof, of these Terms will not affect the validity or enforceability of any other provision or part thereof. In the event that any provision, or part thereof, of these Terms is determined to be invalid or otherwise unenforceable or illegal, the other provisions, or parts thereof, will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Promoter’s failure to enforce any term of these Terms will not constitute a waiver of that term or any other provision of these Terms.
25. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in the Competition–related materials and these Terms, these Terms shall prevail, govern and control and the discrepancy will be resolved in Promoter’s sole and absolute discretion.
26. Except where prohibited by law, participants agree that any dispute, conflict or controversy, howsoever arising out of or broadly in connection with or relating to the Competition or the Prize awarded shall be resolved individually, without resort to any form of class action, and shall be first mandatorily submitted to settlement proceedings under the International Chamber of Commerce Mediation Rules (ICC Mediation Rules). If the said dispute has not been settled within 60 (sixty) days after a request for Mediation has been submitted under the said ICC Mediation Rules, such dispute shall be exclusively and finally resolved by arbitration under the Rules of Arbitration of the International Chamber of Commerce (ICC Arbitration Rules). The ICC Rules’ Emergency Arbitrator provisions are excluded. The dispute shall be resolved by one arbitrator to be appointed in accordance with the ICC Rules. The place of arbitration shall be Amsterdam, The Netherlands. The language of the arbitration shall be English.
27. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms, or the rights and obligations of you and the Promoter or their affiliates in connection with the Competition or the Prize (whether contractual or non-contractual), shall be governed by, and construed in accordance with the laws of England and Wales.
28. Personal data supplied during the course of this Competition will only be processed as set out in Uber’s Privacy Policy.
